Marina Meyer, partner at Manucci Advogados, addresses the recent controversy over the requirement of the AFCI (Arc Fault Circuit Interrupter) device in distributed generation inverters in an interview with Canal Solar – Energia Fotovoltaica Brasil. According to Marina, energy utilities, such as CPFL, must strictly follow INMETRO and ANEEL standards, as established by Law 14.300/2022. “Any measure or requirement implemented by a utility must respect the established technical and legal regulations, ensuring that market agents operate under clear and fair rules,” she states.
Marina highlights that INMETRO has not set deadlines for the commercialization of inverters without the AFCI device, allowing equipment in stock to be sold until it is exhausted. This guidance is crucial to avoid legal uncertainty and ensure that all market players can operate efficiently and within legal parameters. “Uniformity of rules is essential to avoid legal uncertainty and promote competitiveness in the energy sector,” she emphasizes.
Additionally, Marina stresses the importance of continuous dialogue between INEL and INMETRO to ensure that regulations are clear and fair for all involved.
