Since March 21, 2025, Provisional Measure No. 1,292 has been in effect, facilitating access to payroll loans for employees under the CLT regime in private companies in Brazil. Now, all employees can access credit through the Digital Work Card app, without the need for an agreement between the bank and the company. This change aims to modernize and streamline the process, offering advantageous conditions for workers.
The Provisional Measure is valid for 60 days and can be extended, needing approval by Congress to become law. Companies must ensure the correct operationalization of deductions in payroll, including severance pay while the Provisional Measure remains in effect and, if applicable, after its conversion into law. Additionally, they must provide accurate information to public administration and credit operators about payroll, remuneration, and applied deductions.
All amounts deducted from employees must be transferred to Caixa through the payment of the corresponding FGTS guide. The Human Resources department must ensure the accuracy of information and processes related to the government, banks, and employees, as errors can result in financial penalties.
