Earlier this month, CADE adopted measures to prevent anti-competitive practices in the medical and dental sectors. The Society of Cardiovascular Doctors of Maranhão (Cardiovasc/MA) was compelled to suspend the dissemination of fee schedules and professional exclusivity, informing health plans within five days, under penalty of a daily fine of R$ 20,000.
Additionally, another process was opened to investigate possible infractions committed by the Federal Council of Dentistry (CFO), related to the prohibition of discounts by dentists. The 24 Regional Councils under investigation must remove posts linking discounts to unethical conduct and stop proceedings against professionals who offer them, under penalty of a daily fine of R$ 50,000.
The measures aim to protect competition and prevent market damage, but all represented parties will have a chance to defend themselves during the investigation to be conducted by CADE.
The competition team at Manucci Advogados is always attentive to developments in the area in Brazil and around the world through the work of its highly specialized professionals.
